Last Wednesday, November 20th, the Club65 of RACC hosted an online talk as part of the “Meet the Experts” series, titled \u201cClearly Explained: Avoid Conflicts with Inheritances.”<\/p>\n\n\n\n

This was a highly dynamic and easy-to-follow session in which, through the example of a married couple with children and grandchildren, Meritxell Gabarr\u00f3 illustrated a succession planning process that could be considered typical.<\/p>\n\n\n\n

She informed, advised, and engaged the audience by addressing questions raised by her characters, which she resolved with concrete proposals involving succession mechanisms, while also emphasizing the tax consequences of each potential distribution.<\/p>\n\n\n\n

As often happens, the Q&A session at the end brought even greater clarity to an already extensive, comprehensive, and generously informative presentation.<\/p>\n\n\n\n

The key word of the talk was “PLANNING,” which was confirmed by the end of the session to require both a TAX and a CIVIL perspective.<\/p>\n\n\n\n

From a civil perspective, the usual topics once again took center stage: wills, succession agreements, residual trusts, estate administration, and executorship.<\/p>\n\n\n\n

The recommendation to create LOTS prompted the audience to reflect. It is clear that equal inheritance shares are more prone to conflicts.<\/p>\n\n\n\n

From a tax perspective, there was great interest in the possibility of making lifetime donations to reduce the taxable base of future inheritances, highlighting the need to calculate the tax cost of any donation in advance, considering potential capital gains. It was also noted that leaving everything (by inheritance) to the spouse or partner is not the best option from a tax perspective.<\/p>\n\n\n\n

Proper succession planning not only avoids legal complications but also helps maintain family harmony. According to Meritxell Gabarr\u00f3, it is essential to listen to the testator and tailor each decision to their personal needs and circumstances.<\/p>\n\n\n\n
